It’s a reality: parents never stop worrying about their children even when they reach adulthood.

In some cases, the concerns become more complex, especially when an adult child struggles with financial decision-making, substance use, mental health, or other personal challenges. 

Estate planning in these situations goes beyond simply dividing assets. 

Why a Basic Plan Falls Short

A standard will and beneficiary designations that distribute assets outright may work well for financially stable beneficiaries. 

However, it can create problems when a beneficiary is not in a position to manage money responsibly. An inheritance received all at once can be misused, lost to creditors, or create unintended consequences that make an already difficult situation worse.

Even well-intentioned parents sometimes assume that “they’ll figure it out.” In practice, that approach can place a heavy burden on the child and expose the assets to unnecessary risk.

Using Trusts to Add Structure

Trusts offer a more controlled way to provide support. 

Instead of distributing assets directly, a trust allows a designated trustee to manage funds on behalf of the beneficiary. The trustee can make distributions based on specific guidelines, such as covering housing, healthcare, education, or other defined needs.

This approach allows parents to support their child without handing over full control. It also creates a layer of protection from creditors, lawsuits, or external pressures that could otherwise erode the inheritance.

Choosing the Right Trustee

The trustee plays a central role in how the plan works in practice. 

This person or institution will be responsible for making judgment calls about distributions, often in sensitive or evolving circumstances.

Selecting a trustee requires more than picking someone who is trustworthy. The role calls for sound judgment, consistency, and the ability to handle difficult conversations. 

In some cases, families choose a professional trustee to reduce tension or avoid placing a sibling in a challenging position.

Balancing Flexibility and Control

One of the more nuanced aspects of planning in these situations is striking the right balance between guidance and flexibility. 

Plans that are too rigid may not adapt well as circumstances change, while overly open-ended plans may fail to provide meaningful structure.

Thoughtful drafting can allow a trustee to respond to changing conditions while still honoring the parent’s intent. For example, a trust might permit additional support during periods of stability while limiting distributions if certain risk factors are present.

Coordinating With Other Benefits and Protections

For some beneficiaries, eligibility for government benefits may also be a concern.

Planning needs to take into account how distributions are designed so that assistance is not unintentionally disrupted.

This level of coordination is often overlooked in do-it-yourself planning and can have lasting repercussions if not addressed properly.

Planning With Intention

Estate planning for an adult child facing challenges allows a framework that provides support while protecting both the individual and the assets intended for their benefit.

A well-constructed plan reflects a parent’s understanding of their child’s situation and builds in the right level of oversight and protection. It also helps head off the kinds of disagreements and misunderstandings that tend to surface later, giving families a more manageable path forward during an already challenging time.
