Online templates make estate planning look simple.
Fill in a few blanks, print it out, and you’re done. Here’s what those services don’t tell you: estate planning involves a whole lot more than just filling out forms. It’s about understanding how those forms work together under state law, what happens when circumstances change, and whether your documents will actually hold up when your family needs them most.
When Templates Fail
Too many families discover this the hard way.
A father uses an online will template, but it wasn’t properly witnessed. Now his children are in probate court for years longer than necessary. A mother creates a DIY trust that doesn’t coordinate with her beneficiary designations, creating a tax nightmare her kids have to untangle. These aren’t rare situations. They happen constantly.
An estate planning attorney catches these issues before they become problems. We know the witnessing requirements, how to coordinate documents, and which provisions will actually protect your family when tested.
What the Forms Don’t Ask
The problem with DIY estate planning is that you don’t know what you don’t know.
That online form won’t ask if you have a blended family, whether your assets might trigger estate taxes, or if your children’s inheritance could be at risk in a divorce. It won’t flag potential conflicts between your will and your beneficiary designations on assets such as your retirement accounts. It can’t tell you that the guardian you named might not be eligible under state law, or that your power of attorney lacks crucial language your bank will require.
This is where working with an attorney makes all the difference. During a consultation, we ask the questions templates skip. We identify issues specific to your family and structure your plan to address them. In addition, we coordinate all your documents so they work together instead of against each other.
State Law Matters
Estate planning law varies significantly by state.
What works in California might fail in Wisconsin or Illinois. An online template doesn’t know where you live, where your property is located, or which state’s laws will govern your estate. It can’t account for recent legal changes or court decisions that affect how documents should be drafted.
Estate planning attorneys stay current on state-specific requirements and recent legal developments. We draft documents that comply with your state’s laws and anticipate how courts in your jurisdiction will interpret them.
The Execution Problem
Then there’s execution.
Many DIY documents fail because they weren’t signed correctly. Wills have specific witnessing requirements, trusts need to be funded properly, and powers of attorney require notarization. Missing any of these steps can invalidate the entire document, leaving your family with nothing but expensive legal problems.
Cost is usually the reason people go the DIY route, but here’s the math nobody wants to do: a $200 online package versus thousands in probate fees; court costs; and family conflict when those documents don’t work.
What You Get With an Attorney
Your estate plan needs to reflect your specific situation—your family dynamics, your assets, your goals, and your state’s laws.
It should coordinate with your beneficiary designations, account titles, and business interests, and it needs to anticipate problems and prevent them.
We give you a plan tailored to your circumstances, executed correctly, and designed to work when your family needs it. We explain what each document does, answer your questions, and make sure you understand how everything fits together. If your situation changes, we’re here to update your plan accordingly.
Most importantly, working with an estate planning attorney gives you the confidence and peace-of-mind that your family is protected, your wishes will be followed, and you’re not leaving them a mess to clean up during an already difficult time.
That’s not something you can download.
